Like an irrevocable trust, this strategy requires planning ahead. The transfer must occur at least five years before applying for Medicaid to avoid penalty.

Spousal Protections

If a surviving spouse still lives in the home, Medicaid cannot place a lien or recover the property while the spouse is alive. This is called the "spousal impoverishment" rule, and it provides critical protection for married couples. However, once the surviving spouse passes away, the state may still pursue recovery unless additional planning has been done.

Promissory Notes and Caregiver Agreements

In some cases, adult children who provide care for an aging parent may enter into a formal caregiver agreement with compensation. If structured properly and documented legally, payments made under the agreement can reduce the size of the estate subject to Medicaid recovery.
